Terms & Conditions

These Terms & Conditions (“Terms”) apply to memberships, class packs, introductory offers, personal training, classes, workshops, events and other fitness services supplied by Bourne Fitness Limited. By purchasing a product, creating an account, booking or attending a session, you agree to these Terms. Nothing in these Terms limits your statutory rights as a consumer.

1. ABOUT BOURNE FITNESS
Bourne Fitness is operated by Bourne Fitness Limited, company number 15463103, at Unit 6 Grange Mills, Weir Road, Balham, London SW12 0NE. Email: contact@bournefitness.co.uk. WhatsApp/telephone: 07754 329096.

2. OUR SERVICES
We provide small-group fitness classes, Small Group Personal Training, strength and conditioning, HYROX training, Pilates, boxing and conditioning, personal training, 2-to-1 personal training, trials, memberships, class packs, workshops and events. Availability, eligibility and any product-specific conditions are shown at purchase or booking.

3. PRICES AND PAYMENT
Prices, inclusions, validity periods and payment schedules are shown when you purchase. Payment is due using an accepted method. We may refuse or suspend access where payment is overdue or reversed. Promotions and introductory offers may have eligibility conditions, expiry dates and limits, and cannot be combined unless stated.

4. MEMBERSHIPS AND PACKS
Memberships and packs are personal, non-transferable and may not be shared. Recurring memberships continue and payments are taken on the stated schedule until cancelled in accordance with the product terms. You may cancel future renewal through the booking platform or by contacting us before the next payment is due. Fees already paid are not normally refundable, except where the law requires or the product terms expressly allow it. Unused credits expire on the stated date.

5. ONLINE PURCHASES
Where a statutory cooling-off right applies, you may cancel within 14 days of purchase. If you ask us to begin supplying services during that period, we may charge for services already supplied; once a service has been fully performed, the cancellation right may be lost where the law permits.

6. BOOKINGS
Bookings are subject to availability. Eligible direct members may book up to 30 days ahead and bookings may be made until 15 minutes before a class where space remains. ClassPass and other third-party bookings may have different windows and terms. You must ensure your booking details are accurate and arrive in time for the safety briefing and warm-up.

7. CANCELLATIONS AND NO-SHOWS
Cancel at least 2 hours before the scheduled start. A late cancellation may incur an £8 fee; a no-show may incur a £15 fee. If you use a class pack, the relevant credit may also be lost. Different conditions displayed for a specific event, programme or third-party booking will apply to that purchase.

8. WAITLISTS
Waitlist places are offered on a first-come, first-served basis. Where notified, you normally have 2 hours to claim an available place before it may pass to someone else. Joining a waitlist does not guarantee a place.

9. CHANGES OR CANCELLATIONS BY US
We may change coaches, locations, formats or timetables where reasonably necessary. If we cancel a session, we will restore the credit or offer an appropriate alternative. Any further refund rights remain subject to applicable law.

10. HEALTH AND SAFETY
You are responsible for ensuring that you are fit to participate. Tell the coach before a session about any injury, illness, pregnancy, medication or other matter relevant to safe participation. Seek medical advice where appropriate and stop immediately if you feel pain, dizziness or become unwell. Follow reasonable safety instructions and use equipment only as directed. Exercise carries inherent risks that cannot be eliminated, but we will provide services with reasonable care and skill.

11. CONDUCT AND ACCESS
Treat coaches, members, neighbours and property respectfully. We may refuse or end participation, suspend an account or terminate a membership for unsafe, abusive, discriminatory, disruptive or unlawful behaviour, or for serious or repeated breaches of these Terms. We will act reasonably and any statutory rights remain unaffected. Under-18s may participate only where the service permits and any required parent or guardian consent has been provided.

12. PERSONAL BELONGINGS
You are responsible for personal belongings brought to a session. We are not responsible for loss, theft or damage unless caused by our failure to exercise reasonable care or where liability cannot lawfully be excluded.

13. LIABILITY
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or any other liability that cannot lawfully be excluded. Subject to that, we are not responsible for losses that were not reasonably foreseeable, arise from your failure to follow instructions or disclose relevant health information, or are business losses.

14. EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to minimise disruption and tell affected customers where practicable.

15. INTELLECTUAL PROPERTY AND MEDIA
Bourne Fitness branding, training materials and website content may not be copied or commercially used without permission. We will obtain appropriate permission before using identifiable photos or recordings for marketing.

16. CHANGES TO THESE TERMS
We may update these Terms for legal, regulatory or operational reasons. Material changes affecting an existing recurring service will be communicated reasonably in advance where practicable. The latest version will appear on our website with its update date.

17. COMPLAINTS AND GOVERNING LAW
Please contact us first so we can try to resolve any concern. These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts applicable under consumer law.
